USA: CPSC makes eFiling for conformity certificates mandatory for imports

The measure is part of a broader modernization effort by the US regulator to identify risks earlier, strengthen market oversight, and further digitize supply chain processes.

What does eFiling actually mean?

eFiling transmits selected information from a Certificate of Compliance (CoC) electronically to the US Customs and Border Protection (CBP). The notification is made through the Automated Commercial Environment (ACE). From the CPSC’s point of view, this should enable more targeted control of high-risk shipments while making the clearance of compliant imports more efficient.

The existing product safety requirements remain unchanged, the new element is the mandatory digital transmission of the relevant certificate data.

Schedule: Two-stage introduction

• From 8 July 2026: mandatory for imports from third countries
• From 8 January 2027: in addition for goods that initially enter the United States via Foreign-Trade Zones (FTZ) and are subsequently put into free circulation

Which goods are affected?

eFiling applies to imported consumer products that fall under CPSC regulations and require certification. The CPSC has updated its guidance and accompanying HTS list. This includes a non-exhaustive selection of approximately 600 HTSUS positions for which electronic filing is required.

These include the following product categories:

• Children’s products with Children’s Product Certificate (CPC)
• Textiles, clothing and footwear
• Electronics and batteries
• Furniture, household and office goods
• Sporting goods with General Certificate of Conformity (GCC)
