The Swiss IP system, administered by the Swiss Federal Institute of Intellectual Property (IPI/IGE), covers patents, trademarks, designs, and copyrights. Companies benefit from efficient trademark registration in Switzerland, strong patent protection, and reliable enforcement mechanisms backed by a robust legal system with low litigation risks.

Switzerland’s intellectual property law is fully integrated into international agreements, including the EPC, PCT, WIPO Madrid System, and Hague System. This ensures Swiss-based companies can secure and expand IP rights across Europe and globally with speed and cost efficiency. 

Patents

  • Registration options:
    • National patent through the IPI (Switzerland & Liechtenstein)
    • European Patent via the EPO (up to 39 European countries)
    • International protection via the PCT (158 contracting states)
  • Key features:
    • No full novelty examination for national patents → faster, lower-cost registration
    • Protection term: up to 20 years, renewable annually (from CHF 100)
    • Filing cost: CHF 200 application fee + CHF 500 examination fee

Patents arising from employer- employee relationships typically belong to the employer if created within contractual duties, ensuring clear ownership rules. Many businesses first file in Switzerland before extending protection internationally, leveraging cost efficiency and establishing priority under the Paris Convention.

Tax incentives for IP in Switzerland

Switzerland strengthens its innovation ecosystem with IP-related tax benefits:

  • Patent Box: Up to 90% exemption on net income from qualifying patents (national, EPO, or PCT), linked to Swiss-based R&D (Nexus approach).
  • R&D Super Deduction: Up to 50% extra deduction on eligible Swiss R&D staff costs.

These incentives encourage companies to both develop and hold their IP in Switzerland.

Trademark registration in Switzerland

  • Process: Applications are filed via the Swissreg portal at the IPI.
  • Validity: 10 years, renewable indefinitely.
  • Costs: CHF 450 for three classes; CHF 100 for each additional class.
  • Processing time: 6 working days to 2 months.

Since the IPI does not automatically check for conflicts, a clearance search before filing is highly recommended.

International Options

  • WIPO Madrid System: Extend Swiss trademarks to 120+ countries.
  • EUIPO: Apply for EU-wide coverage (Swiss companies require an EU representative).

Swiss applicants can also file international registrations directly via the IPI as the “Office of Origin.”

Design protection in Switzerland

  • Term: Up to 25 years (renewed every 5 years).
  • Requirements: Must be new and sufficiently different from existing designs.
  • Costs: CHF 200 for the first design, with discounts for multiple designs.
  • International filing: Protection in 99 countries via WIPO’s Hague System.
    As with patents, design ownership in employer–employee relationships generally lies with the employer if created as part of contractual duties.

Copyright in Switzerland

Copyright protection is automatic upon creation, covering works such as literature, software, architecture, choreography, music, and art.

  • Duration: Life of the author + 70 years (50 years for software).
  • Ownership: In employer–employee relationships, the same rules as for inventions apply.
  • Support: Management and licensing can be handled via Swiss organizations like SSA and ProLitteris.
