Once a company is set up in India, or when a foreign company or a legal entity decides to enter the Indian market, it may, in its normal course of business, enter into several commercial contracts, including but not limited to, contracts with its vendors, partners and the like.
Typically, commercial contracts provide for a dispute resolution mechanism to enforce any right arising out of the contract in the event of a dispute. In the absence of a dispute resolution mechanism agreed by the parties, a party seeking to enforce its rights under a contract, may approach the appropriate court in India and seek necessary reliefs.
In India, Courts are specifically designated with powers to decide certain types of disputes, depending on the nature of the dispute. That apart, decisions taken by courts may be subject to appeal.
